What is considered personal data

Health data is considered a special type of personal data whose data processing is prohibited without the express consent of the natural person.

We do not process health data that you voluntarily submit to us as additional information when ordering a product or sending an inquiry, which are related to the type of diabetes, therapy, data on measurement records. Processing of health data is possible only with your consent.

Protection and storage of personal data

In order to protect your personal data, we implement administrative, technical and physical protection measures. Your personal information is password protected to prevent theft, alteration, unauthorized access, unauthorized and unlawful use and loss.

Your personal data is stored on a separate password-protected server.

Data collected on any basis are stored for 12 months from the moment of collection, after which they are deleted and the data in paper form is destroyed.

Exceptionally from the above, personal data that you have left when complaining about a medical device, reporting an incident with a medical device (report of malfunction or deterioration of the characteristics, i.e. performance of the medical device, as well as inadequacy in the labeling or in the instructions for use which, directly or indirectly, led or could have led to the death of the patient, user or other person or to a serious deterioration of his health condition), we store for 5 years.

• On the right to request from the Controller access to the data being processed, correction of inaccurate data or deletion of your personal data if they are no longer necessary for the purpose for which they were collected or processed,
• About the right to copies of your personal data,
• About the right to limit the processing of your data,
• About the right to withdraw consent at any time,
• About information on whether profiling is carried out,
• On the right to submit a complaint to the Commissioner.

The operator has the right to ask the applicant for additional information in order to verify his identity.

The method of protection of personal data

We are obliged to inform you and the Trustee about the violation of your personal data, which may cause a risk to your rights and freedoms, without delay or, if possible, within 72 hours of becoming aware of the violation.

with the indication “Protection of personal data” along with evidence (if any).

Regardless of the submission of a request for the protection of personal data, you have the right to:

• To submit a complaint to the Commissioner,
• For judicial protection.

If you submit a complaint to the Commissioner, you have the right to initiate other administrative or judicial protection procedures, regardless of the complaint submitted to the Commissioner.

You also have the right to seek judicial protection by submitting a lawsuit to the court, without the obligation to address the Commissioner. The lawsuit is submitted to a higher court in the territory of which the Controller has a place of residence or headquarters or in whose territory the person to whom the data refer has a place of residence.

Transfer of personal data

Your personal data may be disclosed or transferred:

1. To third parties, when it is necessary for the performance of contractual obligations related to the provision of expert advice or consulting services, who make sure that the work of the site itself is improved, who work on the maintenance and technical support of the site itself. In this situation, only data necessary to fulfill the purpose of the contracted service is transferred and cannot be used for other purposes.

2. To state bodies, if this processing is necessary for the performance of the duties of competent state bodies and if it is prescribed in accordance with Article 13. and Article 100. of the Personal Data Protection Act.

3. To another country, without your prior approval, if that other country is a member of the Council of Europe Convention on the Protection of Individuals with regard to Automatic Processing of Personal Data, as these members provide an adequate level of personal data protection.

Exceptionally, the personal data of the users of our website can be transferred to the company Ascensia Diabetes Care Switzerland in the EU if you have sent us a complaint related to the report of adverse effects of the medical device, whose manufacturers. In this case, the data transfer is protected by a special code.

Changes to the Privacy Policy are always possible when this is required by the Personal Data Protection Act, when we launch new services or process your data for new purposes.
